The Intergovernmental Relations Technical Committee (IGRTC) is an intergovernmental structure created by an Act of Parliament Intergovernmental Relations Act, 2012 to ensure that there is harmonious relation between the County and National Governments and amongst County Governments.
In promoting harmonious intergovernmental relations, IGRTC ensures there is continued service delivery by both levels of government. By delivering services within their assigned functions, the two levels of government are a critical part of the country’s framework for social and economic development.
IGRTC facilitates dialogue and consultations within the intergovernmental structures and provides a platform for enhancing successful devolution as envisaged in the Constitution of Kenya 2010 and vision 2030 especially through addressing intergovernmental disputes. IGRTC promotes the spirit of consultation, cooperation and coordination among its stakeholders.
This is envisaged and provided for in the COK, 2010, Art.6 (2), Art.189 (3), (4); and IGR Act, 2012 s.31. Thus, before reverting to judicial processes, parties to the dispute shall endeavor to seek redress through intergovernmental relations institutions. Article 189(3) of the COK, 2010 addresses the contemplated disputes between the governments. Article 189 (4) further provides that national legislation shall provide procedures for settling intergovernmental disputes by alternative dispute resolution mechanisms including negotiation, mediation and arbitration. IGRA, 2012 ss.30 to 36 gives effect to Art.189 (3) by providing procedures for settling intergovernmental disputes.
Devolution in Kenya is still in its nascent stage hence faces a number of challenges including; perceived or real mandate encroachment by either level of government and competition for power, resources and relevance/space; inadequate commitment to devolution; functional rivalries between the levels of government.
