ADR matters in County Government of Taita Taveta.
ADR plays a crucial role in addressing disputes between different levels of government. In this regard, IGRTC Vice Chairperson Ms. Saadia Kontoma, along with Committee Members Mr. John Kimwela, Mrs. Linet Mavu, and Mrs. Angeline Hongo, conducted a site visit to the Bachuma Livestock Quarantine Station, the subject of a dispute between the County Government of Taita Taveta and the Ministry of Agriculture and Livestock Development.
The County Government of Taita Taveta raised concerns over a Tender Notice published on 23rd July 2024 by the Ministry of Agriculture and Livestock Development, expressing interest in leasing land under the Bachuma Livestock Quarantine Station without involving the County Government. In response, the County sought court orders to halt the lease through case No. ELCLPET/E008/2024 filed at Voi Law Courts before Justice C.K. Kithinji. On 18th September 2024, Hon. Justice E.K. Wabwota issued an order granting IGRTC 60 days to resolve the dispute amicably.
IGRTC, under its mandate, facilitates the resolution of such disputes through ADR mechanisms, as outlined in the 9th Summit resolutions. The Summit emphasized that all existing intergovernmental legal disputes between different levels of government should be handled through ADR, in accordance with the Intergovernmental Relations Act, 2012, with IGRTC as the facilitating body.
The site visit will enable the Committee Members to assess the disputed land and hold consultative meetings to address the key issues underlying the contention between the parties. IGRTC team was accompanied by county officials, led by Grantone Mwandawiro, County Executive Committee Member (CECM) for Water, Sanitation, Environment, Climate Change, and Natural Resources, alongside Voi Deputy County Commissioner, Mr. Daniel Nduti, who represented Taita Taveta County Commissioner.
